The Midas shop in Tulsa left my radiator cap off and my enigne burned up. I had to take them to court, but the judge ruled in their favor, because it is hard to prove that they did it without a confession or witness. They simply lied about the entire thing and I lost the case due to partly not having enough expert witness testimony about first, why they would take the cap off for a clogged a/c drainage line (they may have first suspected the heater core and checked the radiator fluid level, or done a pressure test, or after fixing the line checked the integrity of the cooling system which relies on the integrity of the radiator cap), second how the car could drive an accumulation of short distances for 206 miles before burning up (logic tells you that when a car only drives a short distance of 10 18 miles and is shut down for eight hours or more that it would cool off again and easily driven another short distance), thirdly why didn’t the temperature gage work (it is suggested by a mechanic that since the temperature gage on the vehicle is at the top of the enigne that once the water was low, the gage would not properly read the temperature of air only), fourthly needed a technical expert to explain the photos of the spray off from the radiator (the judge refused to accept my layman’s explanation, even though it was obvious that the white residue had sprayed out of the radiator), fifthly why the radiator cap is enigneered in such a way that it could not possibly come off by itself (the judge used this as an excuse to rule in their favor), and a sixth reason for an expert testimony would have needed to come from another consumer who had experienced Midas negligence, as well as expert testimony about the policy and procedures commonly used by MIdas. My attorney did not aggressively prepare for this case and my guess is the judge was a conservative corporate supporter and possibly biased against female consumers. I can appeal the case, but the expense involved would exceed my budget. Anyone with any suggestions about where to find a good cheap, possibly pro bono appeals attorney is welcome to comment. The Midas corporation really needs to be boycotted and they need to be found guilty of negligence, if not for the money, but the principle of the matter due to the fact that they are a corporation and can get away with lying and causing expensive damage to the little person’s vehicle and do not have to pay one dime in retribution. Shame on our legal system for supporting such corruption and tactics that borderline on criminal intent.
